摘要:無固定期限勞動合同是我國勞動合同的一種重要類型,其對促進社會經濟的發展具有十分重要的價值和功能。但是目前我國關于無固定期限勞動合同制度在立法上仍存在很多缺陷,比如我國無固定期限勞動合同訂立和解除條件存在不足,有不少用人單位和勞動者對這一合同類型認識模糊,在實踐中存在不少誤區,另外無固定期限勞動合同未能考量勞動力市場的現狀,致使導致無固定勞動合同制度不能發揮其最大功能。對此,本文通過對美國、法國和德國的無固定期限勞動合同立法模式的闡述及其對我國的啟示,最終提出完善我國對無固定期限勞動合同制度的具體建議。 關鍵詞:無固定期限勞動合同;勞動關系;三方機制
Abstract:Non-fixed term labor contract is an important type of labor contract in China, it is very important to promote economic development.But,at present, our country's non-fixed term labor contract system in the legislation still exist many defects instance, for example,our country's non-fixed term labor contract, there is insufficient with the conditions of contract and lifting of conditions, many employers and workers misunderstand with the type of labor contract, there are many mistakes in practice, in addition,non-fixed term labor contract failed to consider the status of the labor force, leading to non-fixed labor contract system can not reach its full potential. To this, by the non-fixed term labor contract of the United States,France and Germany, and a description of the legislative model Enlightenment ,finally ,finding some specific suggestions to improvement Chinese non-fixed a fixed term labor contract system.
