摘要:正當防衛是法律賦予公民的一項權利，國家不僅運用社會主義法制同違法犯罪行為作斗爭，而且從道義上和法律上鼓勵和支持人民群眾依法直接同一切不法侵害國家、公共利益、公民的人身、財產等合法權益的行為作斗爭。然而，隨著社會的發展，違法犯罪行為手段的演變，當前正當防衛制度的不足之處也日益顯露出，為了更好地保護公民的合法權益，必須正確認定正當防衛，切實保護正當防衛行為，正確執行正當防衛制度。于是，進一步完善正當防衛制度，值得我們研究和探討。筆者通過對正當防衛的析義，從其司法實踐、對公民的保護方面深入研究，對完善正當防衛制度提出具體的設想。

Abstract:Self-defense is a right of citizens, our country not only using socialist legal system to fighting with criminal acts, but also according to the law to encourage and support people fighting with all criminal violations directly to the Country, the public interest, rights of the person, property and other legitimate rights and interests from a moral and legal. However, with the development of society, self-defense system’s shortage is revealed by means of criminal acts have been changed. In order to protect the legitimate rights and interests of citizens, we must identify self-defense correctly, protect it effectively and perform it correctly. Therefore, it’s worthy of our research and discussion to improve the self-defense system further. The author through analyze self-defense ，which from its judicial practice and the protection of citizens in-depth research. Put forward some suggestion to improve the system of self-defense.
