摘要:無固定期限的勞動合同是勞動合同的一種重要類型。它事關廣大勞動者和用人單位的實際利益，對勞動關系的穩定與和諧影響甚大。《勞動合同法》雖然針對當前勞動用工領域存在的不良現象，通過完善無固定期限勞動合同制度，加大了對勞動者的保護力度，體現了以“保護勞動者合法權益”為核心的立法宗旨，但仍然還存在很多不明確的地方，如有關合同訂立的條件、形式和適用主體的規定以及合同解除的條件、程序和法律后果的規定都有很多漏洞，致使在實踐中引起不少爭議，使得無固定期限勞動合同虛化和勞動合同短期化現象嚴重的問題也仍然難以得到有效解決。有鑒于此，本文對無固定期限勞動合同進行了深入探討。

　　　本文從無固定期限勞動合同的重要地位切入，提出了無固定期限勞動合同在理論和實踐中存在的若干代表性問題，分析了產生上述問題的原因和特點，運用對比等方法闡述了國外在實施勞動合同方面的一些做法及可以借鑒之外，對完善無固定期限勞動合同提出了自己的建議和對策。

In view of this, the paper has no fixed term labor contract was in depth.
