譯文(字?jǐn)?shù) 5795): 歸納起來(lái)無(wú)外乎下列四種:一是指導(dǎo)行政法制定、執(zhí)行、遵守以及解決行政爭(zhēng)議的基本準(zhǔn)則,是整個(gè)行政法的理論基礎(chǔ),是貫穿于整個(gè)行政法的主導(dǎo)思想和核心觀念;二是貫穿行政法之中,指導(dǎo)行政法的制定和實(shí)施等活動(dòng)的基本準(zhǔn)則,它是人們對(duì)行政法規(guī)范的精神實(shí)質(zhì)的概括,反映著行政法的價(jià)值和目的所在;三是貫穿行政法律規(guī)范之中,指導(dǎo)行政權(quán)的獲得、行使及對(duì)其監(jiān)督的基本準(zhǔn)則,也是揭示行政法基本特征并將其與其他部門法區(qū)別開(kāi)來(lái)的主要標(biāo)志;四是只貫穿于行政法始終,指導(dǎo)行政法的制定和實(shí)施的基本準(zhǔn)則或原理,是行政法精神實(shí)質(zhì)的體現(xiàn),是行政法律規(guī)范或規(guī)則存在的基礎(chǔ)。這四種不同的定義體現(xiàn)了學(xué)者們對(duì)行政法基本原則認(rèn)識(shí)的逐步深化,也體現(xiàn)了其所依據(jù)的行政法基礎(chǔ)理論的發(fā)展。同時(shí),上述四種行政法基本原則的概念都包含了相同的含義,即對(duì)行政法制定、實(shí)施等全部活動(dòng)具有指導(dǎo)作用。在行政法基本原則的功能中,其“指導(dǎo)”作用才是最根本的,才是行政法基本原則的核心價(jià)值所在,也是行政法基本借以建立和展開(kāi)的基礎(chǔ)。 基于此,筆者認(rèn)為我國(guó)行政法的基本原則應(yīng)為:合法性原則、民主性原則、及時(shí)救濟(jì)原則和統(tǒng)一原則。 ………………
